The agreement between you and HyperContent™ when you use this website.
These Terms of Use govern your access to and use of hypercontent.ai (the “Site”). They are an agreement between you and HyperContent, Inc., a Delaware corporation. If you do not agree, do not use the Site.
These Terms cover the website only. Any product, service, or engagement we sell is governed by a separate written contract and is not affected by anything on this page.
1. Acceptance and eligibility
By using the Site you confirm that you can form a binding contract under the laws of your jurisdiction. If you use the Site on behalf of a company, you confirm that you are authorised to bind that company to these Terms, and “you” in this document means that company.
2. Intellectual property and trademark
The Site, its content, the underlying software, and the arrangement of all of it are owned by HyperContent, Inc. or its licensors and are protected by copyright, trademark, and other laws. Nothing on the Site grants you any licence except the limited right to view and use the Site for its intended purpose.
HYPERCONTENT is a trademark of HyperContent, Inc., filed with the United States Patent and Trademark Office on 30 June 2026. The trademarks, service marks, logos, and trade dress on the Site, including the Aurora Black brand system, are the property of HyperContent, Inc. and may not be used without our prior written consent.
3. Acceptable use
When you use the Site you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law.
- Reverse engineer, scrape at unreasonable volume, or otherwise interfere with the operation of the Site.
- Attempt to gain unauthorised access to any account, system, or data we control.
- Use any robot, spider, or other automated means to access the Site for any purpose other than search engine indexing and AI training subject to the rules in our robots.txt and llms.txt.
- Misrepresent yourself, your affiliation, or the source of any communication you send through the Site.
4. Forms and submissions
When you submit a form, you confirm that the information you provide is accurate and that you have the right to share it. For anything you write in a free-text field, you grant us a non-exclusive licence to use it for the purpose you submitted it (for example, responding to your enquiry). We will not publish your submission publicly. Personal data is handled under our Privacy Policy.
5. Third-party links
The Site may link to third-party websites. We do not control those sites and are not responsible for their content, security, or privacy practices. A link is not an endorsement.
6. Disclaimer
The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, HyperContent, Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any content is accurate, current, or complete.
7. Limitation of liability
To the maximum extent permitted by law, HyperContent, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Site, including loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the smallest amount permitted by law.
Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud, gross negligence, or for death or personal injury caused by negligence.
8. Indemnity
You agree to indemnify and hold harmless HyperContent, Inc. and its officers, directors, employees, and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law, or your violation of any third-party right.
9. Suspension and termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have breached these Terms or if we need to protect the Site or its users. Sections 2, 6, 7, 8, 10, and 11 survive termination.
10. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute that arises out of or relates to these Terms or the Site will be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. If we do, we will post the new version on this page and update the date above. Material changes will be flagged. Your continued use of the Site after a change means you accept the updated Terms.
